These Terms & Conditions (“Terms”) govern the use of VIPI Auction, a vehicle auction service operated by VIPI Transport (“VIPI”, “we”, “us”, or “our”). By accessing or using VIPI Auction, you agree to be legally bound by these Terms.
If you do not agree, you must not use the service.
1. DEFINITIONS
- Auction: A time-limited bidding process for a vehicle listed on VIPI Auction.
- Seller: Any individual, dealer, or company listing a vehicle for auction.
- Bidder: Any user participating in bidding on an auction.
- Listing Fee: A non-refundable fee paid by the Seller to list a vehicle.
- Bidder Access Fee: A non-refundable fee paid by a Bidder to participate in an auction.
- Winning Bid: The highest valid bid at the auction’s close.
- Reserve Price: The minimum price set by the Seller (optional).
2. PLATFORM ROLE & DISCLAIMER
2.1 VIPI is a marketplace facilitator only.
VIPI does not own, inspect, verify, guarantee, or sell vehicles listed on the platform.
2.2 All transactions are strictly between Seller and Buyer.
VIPI is not a party to the sale contract, transfer of ownership, or payment of the vehicle price.
2.3 No vehicle inspection or verification guarantee.
All vehicle details are provided solely by the Seller.
3. SELLER TERMS
3.1 Seller Eligibility
- Must be legally capable of selling the vehicle.
- Must have the right to list the vehicle.
- Must provide accurate and complete information.
3.2 Vehicle Listing
- Sellers must provide truthful details, images, and disclosures.
- Stock photos are prohibited.
- Misrepresentation may result in suspension or permanent ban.
3.3 Listing Fees
- Mandatory
- Non-refundable
- Charged regardless of auction outcome
3.4 Auction Rules
- Starting price is mandatory.
- Reserve price (if set) must be reasonable.
- Sellers cannot modify auction details once the auction is live.
- Sellers cannot bid on their own vehicles (directly or indirectly).
3.5 Seller Obligations After Winning Bid
- Seller must contact the winning bidder within the specified timeframe.
- Seller must complete the sale in good faith.
- Failure to proceed may result in:
- Account suspension
- Loss of listing privileges
- Legal reporting where applicable
4. BIDDER TERMS
4.1 Bidder Eligibility
- Must be legally able to enter a purchase agreement.
- Must provide valid identity and payment information.
4.2 Bidder Access Fees
- Mandatory
- Non-refundable
- Required before bidding
No refunds are issued if:
- You do not win
- You change your mind
- The reserve price is not met
4.3 Bidding Rules
- All bids are binding.
- Bids cannot be withdrawn.
- Auto-bidding (if enabled) follows platform rules.
- Bidders may not:
- Place fake bids
- Manipulate prices
- Collude with sellers or other bidders
4.4 Winning a Bid
- Winning bidder is legally obligated to proceed with the purchase.
- Failure to complete the transaction may result in:
- Account suspension
- Ban from future auctions
- Legal reporting to relevant authorities
5. PAYMENTS
5.1 Service Fees Only
VIPI collects fees only for platform access (listing and bidding).
5.2 Vehicle Price Payment
- Payment of the vehicle price is handled outside VIPI unless otherwise specified.
- VIPI is not responsible for payment disputes between users.
5.3 No Refund Policy
- Listing fees
- Bidder access fees
6. AUCTION OUTCOMES
6.1 Reserve Not Met
- Auction may end without a winner.
- No fees are refunded.
6.2 Auction Extension
VIPI may automatically extend auctions to prevent last-second bidding (“anti-sniping”).
6.3 Platform Intervention
VIPI reserves the right to cancel auctions, suspend users, or remove listings if fraud, error, or abuse is suspected.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, VIPI is not liable for vehicle condition, ownership disputes, fraud between users, financial loss, or delays in transactions. VIPI’s total liability shall never exceed the fees paid by the user to VIPI.
8. USER CONDUCT & PROHIBITED ACTIVITIES
- Provide false information
- Engage in price manipulation
- Use bots or automated bidding tools
- Harass or threaten other users
- Attempt to bypass payment systems
Violation may result in suspension, permanent ban, or legal action.
9. ACCOUNT SUSPENSION & TERMINATION
No refunds will be issued upon suspension.
10. INTELLECTUAL PROPERTY
All platform content, branding, and software belong to VIPI Transport.
11. DATA & PRIVACY
User data is handled in accordance with VIPI’s Privacy Policy.
12. GOVERNING LAW & DISPUTES
These Terms are governed by the laws applicable in the jurisdiction where VIPI operates.
13. MODIFICATIONS
Continued use of the platform constitutes acceptance of updated Terms.
